مادران نامرئی: چالشهای اخلاقی در ایران بهعنوان مقصد نوظهور رحم جایگزین فرامرزی: یک گزارش مورد. International Journal of Reproductive BioMedicine. 1404; 24 (2) :163-172

مقدمه: رحم جایگزین تجاری بهعنوان یکی از روشهای فناوری کمکباروری، با چالشهای عمیق اخلاقی و حقوقی همراه است. این چالشها بهویژه در کشورهای در حال توسعه، به دلیل نابرابریهای اقتصادی و فقدان مقررات جامع، تشدید میشود.
مورد: این مقاله به بررسی یک مورد واقعی در ایران میپردازد که در آن، یک مادر جایگزین با بارداری دوقلو در هفته 32، بهدلیل خونریزی شدید واژینال، ناچار به انجام سزارین اضطراری شد. این رویداد با مشکلات متعددی همراه بود؛ از جمله عدم حضور والدین ژنتیکی آمریکایی در زمان تولد، تأخیر در صدور شناسنامه نوزادان، انتقال موقت آنان به مراکز بهزیستی، و حذف کامل نام و هویت مادر جایگزین از اسناد رسمی. این وضعیت پرسشهای جدی اخلاقی در زمینه استقلال فردی، بهرهکشی، تبعیض و حقوق کودک را مطرح ساخت.
نتیجه گیری: این مطالعه با تمرکز بر ابعاد اخلاقی خاص این پرونده در ایران، چالشهای گستردهتر مربوط به پدیده رحم جایگزین را مورد تحلیل قرار میدهد. یافتهها نشان میدهد فشارهای اقتصادی میتواند استقلال تصمیمگیری مادر جایگزین را محدود سازد؛ حذف نظاممند هویت مادر در موارد بینالمللی مصداق تبعیض ساختاری است؛ مکانیزم مشخصی برای ارزیابی صلاحیت والدین متقاضی وجود ندارد؛ و در نهایت، نبود چارچوبهای حقوقی و اخلاقی جامع، منجر به آسیبپذیری افراد و نقض عدالت میشود. این پرونده، ایران را بهعنوان مقصدی نوظهور برای رحم جایگزین تجاری معرفی میکند و نسبت به امکان وقوع نوعی «بردهداری مدرن» از رهگذر تجاریسازی و محو هویت مادران جایگزین هشدار میدهد. بر این اساس، توصیه میشود تا زمان تدوین و اجرای قوانین شفاف با مشارکت عمومی و ذینفعان، تمامی موارد رحم جایگزین تجاری، بهویژه نمونههای بینالمللی، بهطور موقت متوقف شود.
